McCarty v. United States Case Certified as a Class Action

Thor Hearne and Arent Fox LLP have been appointed class counsel by the US Court of Federal Claims in McCarty v. United States, Arent Fox’s rails-to-trails case in Martin and Lawrence Counties in Indiana. The court granted Arent Fox’s request to have the case certified as a class action, which means any landowner along the railroad corridor may join this case and seek compensation from the federal government.

Arent Fox filed this case on behalf of Martin and Lawrence County landowners whose property was taken when the federal government issued an order converting the Indiana Railroad through Bedford into the Milwaukee Road Transportation Trailway. More than 50 landowners have already joined the case.

Any landowner who is interested in joining this lawsuit should contact Arent Fox at 314-296-4000 to learn more about making their claim for just compensation. Additional landowners must join by December 29, 2014. After that time, the class will be closed and the parties will move forward with resolving the government’s liability.
